La identidad precipitada. Los límites del derecho como marco para la acción colectiva (Hasty Identity. The Limits of the Law as a Frame for Collective Action)

Durante los últimos 10 años, México registra un incremento de la movilización social a través del derecho. En el presente artículo analizo uno de estos procesos: la campaña de movimientos y organizaciones para aprobar una nueva Ley minera (CNLM) como un mecanismo para frenar la expansión de los megaproyectos mineros. Dentro de las distintas dimensiones de la acción colectiva que formaron parte de la CNLM me enfoco en los procesos enmarcadores. Como producto del análisis del caso, sostengo como argumento que la falta de espacios para consensuar la identidad del movimiento, llevó al rápido agotamiento de la acción colectiva. Además, el proceso evidenció que el derecho –como marco para la acción colectiva–, si bien puede ser efectivo frente a oponentes y opinión pública, resulta problemático a la hora de construir una identidad sólida entre los diversos actores, de manera que sea posible sostener en el tiempo la acción colectiva.
In the past 10 years Mexico has witnessed a significant increase in levels of social mobilization through the use of the law. This article analyzes a campaign of social movements and organizations to promote and push for the enactment of a new mining law in 2012 as a way to stop the rapid expansion of mining projects in the country. As any process of social mobilization there are multiple dimensions of collective efforts; here I pay special attention to framing process. I argue that the coalition between organizations lacked discussions and agreements on the collective identity of the movement, which led to a weak form of collective action. The case study shows that while the law may be a useful framework regarding public opinion, it poses important challenges to build a solid collective identity that serves as unifying factor for sustained collective action.
