Resumen

 

The juvenile penal system has experienced several normative changes since the sanction of the Convention on the Rights of the Child (1990) and the Code of Childhood and Adolescence (2004). These changes explain a prolonged advancement of neopunitivism in Uruguay.  In this context and regarding safety as the main focus of the discussion, the aim of the present work is to show by means of analysis of the content of different documentary sources (projects, laws, explanatory statements and reports) the manner in which this process has generated significant changes in the approach to crime; transitioning from the idea of resocialization to incapacity being a justification for punishment
