Abstract

O objeto desta investigação trata-se do direito à vida digna no ordenamento jurídico brasileiro e as relações do mesmo com o conceito de “vidas precárias” preconizado pela filósofa Judith Butler. A metodologia empregada utiliza-se de revisão bibliográfica e análise documental. A primeira etapa analisa as garantias constitucionais pela doutrina jurídica e publicações em periódicos; a segunda explora a dimensão sociológica da questão. A pesquisa parte da hipótese de que a proteção à vida centrada na criminalização de condutas caminha em contrariedade à concretização das condições necessárias à materialização do direito à vida digna. A conclusão indica que a vida, para que chegue a ser viável, necessita de garantias básicas que a tornem possível, o que implica uma responsabilidade objetiva de garantia de direitos essenciais que minimizem a precariedade dos sujeitos de direito de maneira igualitária.

The object of this investigation is the right to a dignified life in the Brazilian legal system and its relationship with the concept of “precarious lives” advocated by the philosopher Judith Butler. The methodology used uses literature review and document analysis. The first stage analyzes the constitutional guarantees by legal doctrine and publications in journals; the second one explores the sociological dimension of the issue. The research works from the hypothesis that the protection of life centered on the criminalization of conducts is contrary to the implementation of the necessary conditions for the materialization of the right to a dignified life. The conclusion indicates that, in order for life to become viable, it needs basic guarantees that make it possible, which implies an objective responsibility to guarantee essential rights that minimize the precariousness of the subjects of law in an equal manner.
