Protection of the rights of those subject to administration and sustainability in automated decisions

The integration of automated systems into administrative decision-making presents a legal challenge in Spain and the European Union. These tools, which utilize algorithms and artificial intelligence, aim for faster and more efficient decisions, but also generate significant concern for both citizens and the administration if these technologies are implemented without adequate legal safeguards. This study examines the issue from the perspective of Spanish administrative law, analyzing its principles and how they relate to legislation on administrative automation. It will assess whether the Spanish system is prepared to incorporate decisions made by automated systems, extending the analysis to Europe by considering the General Data Protection Regulation (GDPR), rulings of the Court of Justice of the European Union, and new regulations on artificial intelligence.
