The right to care in the workplace

Una sociedad sostenible dentro de los límites planetarios requiere cambios estructurales. El derecho a los cuidados puede contribuir de forma importante a esta transición. Este artículo analiza cómo el derecho laboral podría contribuir a reconocer y aplicar el derecho a los cuidados. Se centra en los derechos individuales a la flexibilidad en el lugar de trabajo. Utilizando ejemplos de la legislación alemana, se demuestra cómo las teorías jurídicas sobre la forma jurídica ayudan a explicar los problemas conceptuales a la hora de armonizar dichos derechos individuales con la negociación colectiva y la representación. Además, se examina cómo, al complementar los derechos individuales con obligaciones positivas para establecer procesos de búsqueda abierto, se podrían fomentar procesos de carácter abierto en los que participen diversas partes interesadas, sometiendo todas las infraestructuras y rutinas existentes a un debate sobre posibles opciones, modificaciones o alternativas. Por último, se defiende este enfoque utópico ante la constatación de que el mundo en el que vivimos hace difícil imaginar que en realidad se puedan dar tales pasos fundamentales hacia la emancipación.
