Abstract

This paper examines the limited practical use of Catalonia’s cohabitation relationships of mutual aid, a legal regime designed to recognise non-conjugal forms of cohabitation beyond traditional family law. It mainly aims to assess the regime’s uptake and empirically test prior doctrinal claims about its marginality, while considering possible solutions. The study draws on care ethics to explain the theoretical relevance of the regime in the context of population ageing, declining fertility, and diversified care arrangements. It surveys notaries practising in Catalonia to examine its frequency, user profiles, barriers to use, and potential remedies. The findings show that the regime is underused and largely invisible in notarial practice, despite being considered socially and demographically relevant by participants. Older collateral relatives appear to be the main user profile, lack of public awareness emerges as the principal barrier, while greater publicity and stronger tax advantages are perceived as key incentives for its use.
