A Transformation of the Judicial Ritual to Criminal Law

Penal mediation is a judicial measure to resolve disputes. This system establishes alternative dispute resolution procedures, the creation of decentralized places of justice and the participation in the exercise of justice of non-lawyers. The ethnographic material used in this contribution deals with the house of justice and law of Fort-de-France’s jurisdiction (Martinique), its interveners and their practices of mediation during the period 2000-2006. The specificities of this conflict resolution procedure are questioned by mobilizing the anthropological literature on ritual as a device for reflexivity that is capable of reconfiguring social order and interpersonal relations. We also focus on the ritual and ceremonial dimensions of the interactions in mediation and we question the references to the symbolic and ritual panoply of the penal law and criminal trial.
La mediación penal es una medida judicial para resolver disputas, y es parte del sistema político de proximidad judicial que se comenzó a implantar en Francia en los años noventa. Dicho sistema establece procedimientos alternativos de resolución de conflictos, la creación de lugares de administración de justicia descentralizados fuera de los juzgados y la participación en el desempeño de la justicia de personas no expertas en leyes. El material etnográfico utilizado en este artículo retrata el juzgado de la jurisdicción de Fort-de-France (Martinica), sus partes interesadas y sus prácticas de mediación durante el período entre 2000 y 2006. Se cuestionan las especificidades de este procedimiento de resolución de conflictos mediante la movilización de literatura antropológica sobre el ritual como herramienta para reflexividad y capaz de reconfigurar el orden social y las relaciones interpersonales. Asimismo, nos centramos en las dimensiones ritualísticas y ceremoniales de las interacciones que se dan en la mediación, y cuestionamos las referencias a la panoplia simbólica y ritual del derecho penal y el juicio penal.
