La regulación de los «funerales de alto riesgo» en Chile

Este artículo examina la Ley 21.717 en Chile, conocida como ley de «funerales de alto riesgo», como un dispositivo sociojurídico que securitiza ciertas formas de duelo público visible y reordena el espacio urbano mediante una racionalidad de penalidad preventiva. Metodológicamente, aplica el enfoque WPR (What’s the Problem Represented to be?) de Carol Bacchi al texto legal, su historia legislativa , con el fin de reconstruir la representación del «problema» e identificar sus supuestos, silencios y efectos. Se muestra que la norma configura determinados funerales como amenazas al orden público y, al hacerlo, delimita territorios «riesgosos» y sujetos problematizados, estableciendo jerarquías sobre el duelo: quiénes pueden ser llorados, bajo qué condiciones y qué formas de duelo público son toleradas o reprimidas. Al articular WPR con debates sobre gubernamentalidad, política del duelo y regulación urbana, el artículo contribuye a discusiones sociojurídicas sobre seguridad, desigualdad urbana y visibilidad pública.
