Abstract

L’article aborde la question de la ritualisation judiciaire en relation aux concepts de symbolisation et d’efficacité symbolique propres au champ psychanalytique et à l’anthropologie. Il s’agit donc d’une contribution théorique qui soutient que la ritualisation dans le champ juridique gagnerait à se penser pragmatiquement et no sémantiquement pour saisir son efficacité. Plus qu’interpréter le décor du rituel juridique ou les signes de la justice avec une approche herméneutique, l’article propose l’intérêt de saisir ce qui se fait à travers les signes et les paroles, l’acte qui est accompli, lequel serait au fondement de l’efficacité. L’argument invite à considérer que dans un procès juridique on peut dire des choses avec des peines, mais aussi il est possible de faire des peines avec des mots.

The article treats the question of judiciary ritualization in relation to the concepts of symbolization and symbolic efficiency specific to the psychoanalytic field and anthropology. It is therefore a theoretical contribution that sustains that ritualization in the juridical field would benefit from thinking pragmatically and not semantically to grasp its effectiveness. Rather than interpreting the setting of juridical ritual or the signs of justice with a hermeneutic approach, the article proposes the interest of grasping what is done through signs and words, the act that is accomplished. This act would be in the foundation of the efficiency of judiciary ritualization. The argument suggests that in a juridical process it is possible to say things with sentences, but also it is possible to make sentences with words.

El artículo trata el tema de la ritualización judicial en relación con los conceptos, específicos del psicoanálisis y de la antropología, de simbolización y eficacia simbólica. Es, por tanto, una contribución teórica que sostiene que la ritualización en el campo judicial ganaría si se pensara pragmáticamente y no semánticamente para comprender su eficacia. Más que interpretar la escenificación del ritual judicial o los signos de la justicia desde un enfoque hermenéutico, el artículo defiende el interés de comprender lo que se hace a través de signos y palabras, el acto que se lleva a cabo. Este acto estaría en la base de la eficacia de la ritualización judicial. La tesis que se sostiene es que en un proceso judicial se pueden decir cosas con las penas aplicadas, pero también es posible hacer penas con palabras.
