Transforming attendance at the International Criminal Court
Judicial approaches to remote participation of witnesses and the accused

Este artículo examina cómo la Corte Penal Internacional (CPI) ha abordado la participación a distancia tanto de los testigos como de los acusados, y cómo estas prácticas han influido en las actitudes respecto a la presencia. Mediante el análisis de las resoluciones de la CPI en las que se ha autorizado la participación a distancia, y basándonos en la investigación doctrinal actual sobre la justicia virtual, demostramos que la práctica judicial sigue estando fragmentada. Los jueces de la CPI tienden a permitir el testimonio a distancia de los testigos con mayor apertura que la participación a distancia de los acusados, basándose en interpretaciones inconsistentes del concepto de presencia. Sostenemos que se necesita un marco más claro y coherente, que sitúe en el centro los derechos del acusado a un juicio justo.
