Shifting discourses in the struggle over holiday rentals

A comparative socio-legal analysis of social mobilisation, legal reform and judicialization in Barcelona and Edinburgh

Resumen

Este artículo examina los discursos en transformación que intervienen en el conflicto sociojurídico que se está desarrollando en torno a los alquileres vacacionales o de corta duración. Centrándose de forma comparativa en Barcelona y Edimburgo, el artículo lleva a cabo un análisis que abarca la movilización emprendida por activistas y grupos de presión, las reformas adoptadas por autoridades locales y parlamentos, y las intervenciones judiciales, a fin de (1) identificar la emergencia de regímenes restrictivos para los alquileres de corta duración, a medida que éstos han pasado de ser una práctica en su mayor parte inocua a convertirse en una amenaza para la identidad de la urbe y su vida colectiva; (2) poner de relieve el papel decisivo del activismo de base y los procesos democráticos a la hora de impulsar este cambio, junto con la resistencia de los grupos rentistas a través de lobbying y recurso a los tribunales; (3) destacar el doble papel del derecho como herramienta para regular los alquileres de corta duración y como marco que limita los esfuerzos reguladores mediante el control judicial, observándose una divergencia significativa en este último respecto en los dos contextos; y (4) en última instancia, ensalzar el rol que deben desempeñar la sostenibilidad social y el bienestar de las comunidades locales en la gobernanza del turismo.
