Sustainable tourism for whom? : Heterotopias, jurisdiction and the protection of workers on-board cruise ships

Resumen

En su conferencia De los espacios otros, el filósofo francés Michel Foucault introdujo el concepto de «heterotopías», identificando el barco como la heterotopía por excelencia debido a su característica única de ser un espacio flotante que se desvía de las normas sociojurídicas que rigen la sociedad y las subvierte. Partiendo de métodos jurídicos doctrinales en diálogo con las heterotopías de Foucault, el presente artículo analiza críticamente la experiencia de separación física, jurídica y social de los trabajadores a bordo de los cruceros, lo que exige entender estos buques como heterotopías por excelencia al cuadrado. En consecuencia, examina su experiencia de doble liminalidad a través del prisma del derecho del mar y del derecho internacional de los derechos humanos, poniendo de manifiesto la brecha en su protección bajo ambos regímenes jurídicos debido a sus diferentes conceptos de «jurisdicción». El artículo concluye discutiendo una posible solución a dicha brecha jurisdiccional, basándose en la propia noción de heterotopía y en las características especiales del trabajo a bordo de los cruceros, con el fin último de eliminar la distancia entre ambos regímenes.
