Managing feelings, making deals: The emotion work of Italian commercial mediators

Resumen

Este artículo analiza el trabajo emocional de los mediadores mercantiles, una categoría de profesionales del derecho cuyas emociones han recibido escasa atención en investigaciones sociojurídicas anteriores. Hasta la fecha, la literatura sobre derecho y emociones ha examinado ampliamente las emociones en los procesos penales, centrándose especialmente en las emociones de jueces, jurados, fiscales y abogados. Se sabe mucho menos sobre las emociones en la resolución de conflictos mercantiles, donde a menudo se da por sentado que los conflictos se rigen por un cálculo racional desprovisto de emociones. A partir de observaciones de mediaciones mercantiles y entrevistas con mediadores mercantiles de Italia, el artículo muestra diferentes dimensiones del trabajo emocional de los mediadores: trabajar con emociones epistémicas, como las corazonadas y el miedo; gestionar las identidades profesionales; actuar con imparcialidad; y dosificar la empatía. Además, demuestra cómo los mediadores infunden sentimientos de esperanza y duda en las partes para mantener su compromiso y atenuar la certeza. De este modo, el artículo contribuye a la investigación sociojurídica sobre las emociones en las profesiones jurídicas, la resolución de disputas y los conflictos económicos.
