Child/youth leadership and climate cases: Postpaternalism in the courts?

Resumen

Este artículo examina el fenómeno del liderazgo infantil y juvenil en el ámbito de los litigios climáticos. Sostenemos que forma parte del «pospaternalismo», según el cual niños, niñas y jóvenes participan en acciones de base (por primera vez, a escala mundial), en lugar de que sean adultos bienintencionados los que les «concedan» sus derechos. Se ofrece un análisis de quince casos climáticos en los que han participado niños y jóvenes. Identificamos que el liderazgo de los niños es inherente a su participación en estos casos y, en particular, a la forma en que hacen valer sus derechos constitucionales y humanos como actores jurídicos. Encontramos referencias significativas en las demandas al liderazgo de los niños en sus comunidades y países. Los niños ejercen el liderazgo tal y como ellos lo entienden en nombre de todos los niños y jóvenes, o en nombre de la humanidad en general. Encontramos algunas referencias limitadas a su liderazgo en las sentencias y los resultados de los casos. Concluimos argumentando que la participación de los niños y jóvenes en estos casos es crucial para los derechos humanos y para el clima.
