This paper intends to bring about a reflection on the judiciary system in the context of the quilombolas territorial conflicts. It focuses on the analysis of a recent landmark decision in favor of the territorial rights of the Paiol de Telha community, in order to understand the emancipatory character of this decision.
Este trabajo busca reflexionar sobre la democratización de la justicia en el contexto de la judicialización de los conflictos territoriales quilombolas. Se centra en el análisis de una reciente y emblemática decisión a favor de los derechos territoriales de la comunidad Invernada Paiol de Telha, con el fin de comprender los sentidos emancipadores de esta decisión y su conexión con la democratización del sistema judicial.
