El objeto de este trabajo y su aportación más específica es abordar el problema de la gestación subrogada por medio de una perspectiva narrativa. Con ello se quiere contribuir al debate sobre la oportunidad o inoportunidad de su institucionalización jurídica y de su reconocimiento como derecho. A tal efecto, tras el correspondiente análisis de la situación jurídico-legal en España, se hará un análisis doble. En primer lugar, uno de carácter jurídico-constitucional, en que se tendrán en cuenta especialmente los derechos reproductivos y los valores de igualdad, libertad y dignidad. En segundo lugar, se abordará la cuestión desde el punto de vista de la ética biomédica, considerando las dos metodologías más corrientes, principialismo y casuismo. Por último, se abordará la cuestión desde una perspectiva narrativa.
The purpose of this paper and its more specific contribution is to address the problem of surrogacy through a narrative perspective. The aim is to contribute to the discussion on the convenience or inconvenience of its legal institutionalization and its recognition as a right. To this end, after the pertinent analysis of the legal situation in Spain, a twofold analysis will be made. Firstly, a legal and constitutional analysis, in which reproductive rights and the values of equality, freedom and dignity will be especially taken into account. Secondly, the issue will be approached from the point of view of biomedical ethics, by considering the two most common methodologies, principlism and casuistry. Finally, the question will be approached from a narrative perspective.
