Disturbing the boundaries of law
A killjoy for a dear-guts constitutionalism

This text proposes rethinking constitutional practice from an ethical and political discomfort. Drawing inspiration from Sara Ahmed’s figure of the feminist killjoy, the constitutional killjoy is presented as one who questions, disrupts, and provokes conflict against the homogeneous and conservative logic of modern/colonial constitutionalism. Modern/colonial constitutionalism, heir to European modernity and the coloniality of power, conceals structural inequalities, hierarchizes subjects, and reproduces the fantasy of individuality that excludes women, indigenous peoples, racialized bodies, and sex-gender minorities. Dear-guts constitutionalism is posed as an alternative: a situated, relational, and affective normative practice that claims the right to appear, the visibility of historically silenced bodies, and the collectivization of wounds to transform structures of oppression. Finally, the manifesto of the constitutional killjoy is presented, articulating principles such as causing discomfort, supporting others, rejecting inclusion that entails assimilation, returning chance to justice, and collectively constructing processes of subjectivation that transform the structural framework of power.
