Abstract

This article analyses the epistemological tension between Forensic Social Work (FSW) expert testimony and the logic of criminal law. It argues that while criminal proceedings operate under the Paradigm of Simplification —structured around the principle of the Excluded Third and oriented towards producing binary legal certainty— FSW introduces a rationality of complexity that recognises the coexistence of multiple dimensions within a single event. Drawing on a critical-documentary analysis with a socio-legal hermeneutic perspective, the article examines the epistemological foundations of this collision, the symbolic geography of the courtroom as a territory of power, and six comparative experiences (Argentina, Colombia, Spain, Peru, Germany and the Nordic countries) that illustrate how this tension is institutionally processed. It concludes that the technical autonomy of FSW is the condition of possibility for a legal truth that is not alien to the material conditions of subjects, and that decolonial and restorative justice frameworks offer pathways beyond punitive reductionism.

Doctor en Ciencias Sociales; Postdoctorado en Principios Fundamentales y Derechos Humanos; Licenciado en Trabajo Social. Es Profesor en la Universidad Nacional del Litoral (UNL, Argentina) y en otras Universidades. Es Director de la Maestría en Trabajo Social Forense (Universidad Católica de Salta) y de la Especialización en Trabajo Social Forense (Universidades Nacional del Litoral y Nacional de Rosario). Fue Trabajador Social Forense en el Poder Judicial de la Provincia de Santa Fe (Argentina) durante 35 años.
