The process of specification of Human Rights put on the public agenda the problems surrounding human beings as elders. For its part, Elder Law has managed to incorporate the Paradigm of Inclusion and the Human Rights Approach as a systemic whole. The Paradigm of Inclusion, is a reaction against the processes of discrimination against the elderly, and is recepted by the iusfundamental model, presenting a logic that aims at strengthening the autonomy of elderly subjects, preventing unwarranted intervention of third parties in their sphere of freedom.
Elder Law, has built its core around the Fundamental Right to Life Quality of Elders. Consistent with our Integrative three-dimensional trialist perspective of the law, in its analysis, we unveiled the sociological axilogical and normative faces, dimensions that enrich us. It could not be otherwise, because the disengagement from the social and axiological dimension of old age, that is: putting aside the vicissitudes of the life of elders and their axiological meanings, would be to become willfully blind. The Supreme Principle of Justice requires organizing the group, that each one has a sphere of freedom -so broad-, that he can develop his personality, from individual to person.
The challenge of the Law in Postmodern times is to maintain the humanist sense of the system, and to understand the demands of a global population that requires from it an unprecedented effort for its organization.
El proceso de especificación de los Derechos Humanos puso en la agenda pública las problemáticas del ser humano en su condición de viejo. Por su parte, el Derecho de la Vejez ha logrado incorporar al Paradigma Inclusivo y la perspectiva de los Derechos Humanos en un todo sistémico. El paradigma de la inclusión, surge como reacción ante el panorama gravoso adidenciado en los procesos discriminatorios contra la ancianidad, y es receptado por el modelo jusfundamental, presentando una lógica que apunta a reforzar la autonomía del sujeto anciano impidiendo la intervención injustificada de terceros en su esfera de libertad.
El Derecho de la Vejez, ha construido su núcleo en derredor del Derecho Fundamental a la Calidad de Vida de los Ancianos. En coherencia con nuestra perspectiva integrativista tridimensional trialísta del Derecho, en su análisis develamos la faz sociológica, valorativa y normativa que nos enriquecen. Y no podría ser de otra manera, ya que el desentendimiento de la dimensión social y valorativa de la vejez, es decir, el poner a un lado los avatares de la vida misma del viejo y sus significaciónes axiológicas, implicaría enceguecer voluntariamente la mirada. El principio supremo de justicia exige organizar a la agrupación de tal suerte que cada uno disponga de una esfera de libertad tan amplia que le sea posible desarrollar su personalidad, convirtiéndose de individuo en persona.
El desafío del Derecho en la Posmodernidad, consiste en mantener el sentido humano del ordenamiento, comprendiendo las exigencias de una población global que requiere de él un esfuerzo sin precedentes para su organización.
