Abstract

This paper analyzes the relevance of the popular legislative initiative in the Chilean institutional system. For that purpose, we will investigate its origins and the unique process of extrapolation that took it from Europeans parliamentarians systems to Latin American presidentialism. We will deliberate about the consequences of this extrapolation and the experience founded in Latin America. All of the aforementioned has the purpose to establishing the best manner to ensure participation in the Chilean legislative process. This will finally lead us to opt for another mechanism: the popular initiative that allows abrogating laws.

Actualmente, es Profesor Asociado del Departamento de Derecho Público de la Facultad de Derecho de la Universidad de Chile e integra el Comité Académico del Programa de Doctorado en Dicha Institución, imparte cursos de Derecho Constitucional, Ciencias Políticas y Derecho Comparado.
