Los Errores de Legislar en Paralelo: La Problemática Aplicación de las Reglas sobre Filiación (Determinación, Acciones de Reclamación e Impugnación) en la Filiación Derivada del Uso de Técnicas de Reproducción Humana Asistida (Mistakes of Legislating...)

The incorporation of ‘will’ as a way to define the filiation derived from the use of assisted reproduction techniques (without establishing a new determining method [against the biological and adoptive filiations]), plus the recognition of equal marriage and the consequent access to double maternity/paternity, plus the deficient regulation of the text in the assisted reproduction techniques’ law (art. 7), with a general remission to civil laws, have created a legal loophole that is being incoherently covered; all the jurisprudential decisions and disconnected resolution create (or are creating) a misadjusted situation that should be confronted with an adequate legislative reform. Are the determination, reclamation and impugnation rules (which are expected in the CC for the filiation by nature) really applicable (in a context?) out of the special rules expected in the assisted reproduction techniques’ law?
La incorporación de la voluntad como forma de determinar la filiación derivada del uso de TRHA, sin establecer una nueva modalidad de determinación (frente a la filiación por naturaleza y la adoptiva), el reconocimiento del matrimonio igualitario y el acceso a la doble paternidad/maternidad derivado de tal reconocimiento, junto con la deficiente regulación en el texto de la LTRHA (art. 7) con su remisión genérica a las leyes civiles, han creado un vacío legal que se está cubriendo de forma incoherente, al albur de decisiones jurisprudenciales y resoluciones desconexas que crean una situación de desajuste que debería afrontarse con una adecuada reforma legislativa. Fuera de las reglas especiales previstas en la LTRHA, ¿resultan aplicables realmente las reglas relativas a la determinación, reclamación e impugnación previstas en el CC para la filiación por naturaleza? Se trata de dar respuesta aquí a las soluciones a las que se llega con los diversos textos legales existentes.
