Familias, Cambios Normativos y Representaciones Sociales de alumnos/as de Derecho (Families, Regulatory Changes and Social Representations of Law Students)

As an exploratory research and through the administration of a questionnaire to law students at University of La Pampa (Argentina), we analyze the perceptions they have about the right to form a family as a social relevant subject. A process of legal reforms related to adapt national regulations to the international law of human rights mandate is taking place in Argentina, therefore investigating about what meaning, extension and content future law operators adjudge to certain rights has turned relevant. It is possible to conclude, based on the answers provided by the alumni, that they have a limited perception of the concept suggested, anchored in the classic and traditional perspective of family law, with a lack of presence of phenomena such as the use of assisted reproductive technics, equal marriage, gender identity and diversity, the right to form a family as a fundamental human right, access to justice, among others.
A partir de la administración de un cuestionario a alumnos/as de Derecho de la Universidad Nacional de La Pampa (Argentina) se aborda exploratoriamente el registro y las percepciones respecto del derecho a formar una familia como objeto socialmente relevante. Debido a que Argentina vive un proceso de reformas legales orientadas a la adaptación de la normativa interna a los mandatos del derecho internacional de los derechos humanos, resulta pertinente indagar sobre qué significado, alcance y contenido otorgan los futuros operadores a ciertos derechos. Del análisis de las respuestas brindadas por los/as alumnos/as de Abogacía surge que éstos tienen una percepción limitada de los conceptos sugeridos, anclada en perspectivas clásicas y tradicionales del derecho de familia, siendo débil la presencia de fenómenos tales como el uso de las técnicas de reproducción humana asistida, el matrimonio igualitario, identidad de género, el derecho a formar una familia como derecho humano fundamental, el acceso a la justicia, entre otros.
