In some respects, the legal response to violence against women has gone ahead of cultural change. This gap allows the resurgence of old myths and strategies against gender equality, such as the so-called "counterclaim", that is, the man who has been denounced as an aggressor by his partner, in turn, accuses her from violence against him.
In addition to the context in which these cross complaints arise, this paper presents the results of a study based on a group of sentences pronounced in Biscay, in which both man and woman are condemned for gender-based violence. It concludes that, beyond the principles, the criminal justice system treats women more rigorously.
