El Problema de los Matrimonios Forzados como Violencia de Género (The Problem of Forced Marriage as a Form of Gender-based Violence)

Forced marriages is a phenomenon that appears linked to migration, but it results difficult to be defined due to its confusion with arranged marriages, fraudulent marriages or marriages of convenience. It is a little known issue in Spain, but not in other European countries that have a larger experience in migration issues and management of multiculturality. In Europe, sometimes forced marriages have been associated to a migration problem, some other times to a religion one, eventually it has been understood only as a cultural problem or as a form of gender violence. Depending on which is the diagnosis and explanation of this phenomenon, it varies the way the law regulates it. The present article identifies the main difficulties the law faces when approaches forced marriages as a form of gender violence of great complexity.
Los matrimonios forzados es un fenómeno que aparece ligado a la migración, pero de difícil conceptualización por su confusión con los matrimonios pactados, los matrimonios fraudulentos o los matrimonios de conveniencia. Es una cuestión poco conocida en España, pero no en otros países europeos que cuentan con una más larga experiencia en cuestiones migratorias y gestión de la multiculturalidad. En Europa unas veces se ha vinculado los matrimonios forzados a un problema migratorio, otras veces religioso, en ocasiones se entiende como problema únicamente cultural y otras veces como una forma de violencia de género. Dependiendo de cuál es el diagnóstico y la explicación de este fenómeno, varía la forma en la que el derecho lo regula. El presente artículo identifica las principales dificultades que la ley se enfrenta para dar una respuesta a los matrimonios forzados, como una forma de violencia de género de enorme complejidad.
