Adult sexual deepfakes as a crime against moral integrity

The emergence of generative artificial intelligence has posed a new challenge for Criminal Law. While the commission of crimes through technological tools is not a novel phenomenon, what is new is the ease of Access to them and their capacity to generate content with a virtually absolute appearance of reality. In the case of non-consensual sexual deepfakes, their proliferation has expanded exponentially over the last three years. This phenomenon disproportionately affects women, operating as an online reflection of the patriarchal structures of dominance and subordination present in the offline world. The objectification of women and the commodification of their bodies through the generation of this content are analyzed here as a criminal offense of degrading treatment under Article 173.1 of the Spanish Criminal Code. Nonetheless, the study also addresses other doctrinal lines that propose the subsumption of these attacks under offenses against honor, the right to own’s own imagen, or privacy.
