Abstract

El objetivo de este artículo es presentar un enfoque sociológico-jurídico, sobre todo basado en la teoría de los sistemas sociales, sobre el problema de la desinformación masiva a través de redes y plataformas digitales. Para tanto, el trabajo analiza las fake news como un fenómeno emergente a partir de una transformación estructural en los medios de diseminación de la comunicación, y en seguida enfoca el caso de la regulación brasileña sobre el tema. La hipótesis directiva de la investigación es de que es posible identificar un paquete de estrategias de aprendizaje regulatoria por el sistema jurídico. El texto aborda específicamente el caso de fake news sobre el tema de la salud. Observa que, en este campo de las fake news sanitarias, faltan propuestas capaces de combinar formas de prevención y no sólo represión de los daños.

The purpose of this paper is to present a socio-legal approach, mainly based on social systems theory, to the problem of mass disinformation through digital networks and platforms. To this end, the paper analyses fake news as a phenomenon emerging from a structural transformation in the means of communication dissemination, and then focuses on the case of Brazilian regulation on the subject. The guiding hypothesis of the research is that it is possible to identify a package of regulatory learning strategies by the legal system. The text specifically addresses the case of fake news on the subject of health. It notes that, in this field of medical fake news, there is a lack of proposals capable of combining forms of prevention and not only repression of damage.

Marco Antonio Loschiavo Leme de Barros, Mackenzie Presbyterian University

Assistant professor at the Law School of Mackenzie Presbyterian University, São Paulo, Brazil. He was a postdoctoral researcher at the University of São Paulo (USP) International Relations Institute, and a visiting researcher at the University of California, Los Angeles, USA, and at Oñati International Institute for the Sociology of Law, Spain.

 

Lucas Fucci Amato, University of São Paulo

Associate professor at the Department of Jurisprudence and Philosophy of Law, University of São Paulo Law School, Brazil. He was a visiting researcher at Harvard Law School, USA, and an academic visitor at the University of Oxford, UK, Centre for Socio-Legal Studies.
