From a different perspective, the article intends to discuss the scant importance that studies usually assign to a theoretical reflection that decades before already had a notable capacity to influence the development of public policies. In this direction, the incidence that the pioneers of sociological thought had in the formation of the ruling class that was formed in the classrooms of the Faculty of Law and Social Sciences at the beginning of the century is highlighted. Authors such as A. Comte, H. Spencer, L. The research project is a based in a qualitative and quantitative methodology. This paper discusses the initial results from interviews gathered in the city of Manaus with a Judge from the Amazonas State, a Prosecutor from Public Ministry, a Federal Police Commissar, and a member of the Environmental Agency of Amazonas. Con este punto de partida, nos basamos en un caso jurídico emblemático sobre la expulsión de una joven migrante del país, cuya defensa fue llevada a cabo por la Clínica Jurídica de la Comisión Argentina para Refugiados y Migrantes (CAREF) y el Centro de Estudios Legales y Sociales (CELS), una de las sedes donde funciona el Patrocinio Jurídico gratuito de la UBA. A partir de este relato promovemos una reflexión crítica en torno al análisis sociológico del conflicto humano que trasciende el caso jurídico, la solución más allá del derecho, y la construcción colectiva del conocimiento jurídico. En las conclusiones planteamos la necesidad de (re)pensar tanto la enseñanza del derecho como su ejercicio profesional, en contextos de grandes demandas sociales para el goce de derechos humanos.</p> <p>In this article we propose to undertake an autoethnography of our stage as students of the mandatory professional practice at the School of Law of the University of Buenos Aires (UBA), Argentina. With this starting point, we rely on an emblematic legal case of expulsion of a young migrant from the country, whose defense was conducted by the Legal Clinic of the Argentine Commission for Refugees and Migrants (CAREF) and the Center for Legal and Social Studies (CELS), one of the sites where the free Legal Aid of the UBA operates. From this case we promote a critical reflection on the sociological analysis of human conflict that transcends the legal case, the solution beyond the law, and the collective construction of legal knowledge. I will argue that the two models reflect different ideals of the legal profession and the role of lawyers in society. While university free legal aid services aim to provide a legal service to those who do not have the financial resources to face it and, hence, encourage students to develop a sense of empathy and concern for the most disadvantaged members of society, public interest law clinics’ strategy is to choose a very small amount of cases of high public impact, that account for serious structural inequalities and that are capable of generating innovative and transformative jurisprudence. Taking this in mind, the question that should be posed is: In countries with high rates of poverty and serious deficiencies in access to justice, but also with serious structural and institutional problems, what kind of practical education should be provided in law schools?</p> <p>El objetivo de este artículo es estudiar dos modelos de educación práctica llevados adelante en escuelas de derecho: el modelo de las clínicas de interés público y el de los servicios de asistencia jurídica gratuita. Sostendré que los dos modelos reflejan diferentes ideales de la profesión jurídica y del papel de los abogados en la sociedad. Mientras que los servicios de asistencia jurídica gratuita buscan proporcionar un servicio a quienes no tienen recursos económicos y, por lo tanto, animan a los estudiantes a desarrollar un sentido de empatía y preocupación por los miembros más vulnerables de la sociedad, las clínicas de interés público tienen la estrategia de trabajar con una pequeña cantidad de casos de alto impacto público, que dan cuenta de graves desigualdades estructurales y que son capaces de generar innovaciones y jurisprudencia transformadora. Por isso, o objetivo é valer-se de um caso concreto, que facilmente atinja acadêmicos em seus diferentes níveis de formação, para colocar em evidência, de forma exemplificativa, a fundamentalidade da promoção dessa disciplina nos currículos dos futuros operadores do direito. O caso eleito é a Lei brasileira de acesso ao patrimônio genético e aos conhecimentos tradicionais associados (Lei da Biodiversidade). Ao analisar os aspectos considerados como questionáveis da norma, o artigo sublinha o fato de que ela constitui um exemplo concreto do caráter ambivalente do processo de juridicização e, em consequência, da importância da antropologia jurídica para identificá-lo. Como o artigo não apenas discute a importância desta última nos currículos, mas também ele próprio é desenvolvido à luz dela, inicialmente parte-se de como foi o processo que conduziu a que a antropologia contribuísse à discussão do direito. Em segundo lugar, os aspectos controversos da lei são trazidos. Na sequência, dois autores da disciplina são mobilizados: primeiramente, o Professor de antropologia jurídica da Faculdade de Direito da Universidade de São Paulo (USP) Orlando Villas Bôas Filho, sobre o fato de que, não raras vezes - e como exemplificado no caso concreto -, o processo de juridicização pode acabar por atender interesses contrários aos dos povos indígenas. Isto feito, mobiliza-se o autor francês do Laboratório de Antropologia Jurídica de Paris (LAJP) Étienne Le Roy e sua Teoria do Multijuridismo, estabelecendo-se relações entre ela e o caso concreto eleito, em diálogo com intelectuais/líderes indígenas. A metodologia seguida foi a sistêmica e a técnica de pesquisa baseou-se na revisão bibliográfica e interpretação de normas legais e decretos regulamentares.</p> <p>Despite the importance of legal anthropology for the discussion of law, the discipline appears in only a small part of the course curricula, globally. Therefore, the objective is to use a concrete case, which easily reaches academics at their different levels of training, to highlight, in an exemplifying way, the fundamentality of promoting this discipline in the curricula of future legal professionals. The chosen case is the Brazilian Act on access to genetic heritage and associated traditional knowledge (Biodiversity Act). By analysing the aspects considered as questionable of the norm, the article highlights the fact that it constitutes a concrete example of the ambivalent nature of the juridicization process and, consequently, the importance of legal anthropology to identify it. As the article not only discusses the importance of the latter in curricula, but is itself also developed in light of it, it initially starts with how the process was that led anthropology to contribute to the discussion of law. Secondly, the controversial aspects of the Act are brought to the fore. Following this, two authors of the discipline are mobilized: firstly, the Professor of legal anthropology at the Faculty of Law of the University of São Paulo (USP) Orlando Villas Bôas Filho, on the fact that, not infrequently - and as exemplified in the concrete case -, the juridicization process may end up serving interests contrary to those of indigenous peoples. This done, the French author from the Laboratory of Legal Anthropology of Paris (LAJP) Étienne Le Roy and his Theory of Multijuridism are mobilized, establishing relationships between it and the concrete case chosen, in dialogue with indigenous intellectuals/leaders. Em 2021, seu primeiro ano de funcionamento, o PAD buscou oferecer suporte pedagógico para estudantes negros/as, descendentes de grupos indígenas, de baixa renda e/ou egressos/as de escolas públicas que desejassem se preparar para o processo seletivo de ingresso no Mestrado Acadêmico da Instituição. À luz dos debates recentes sobre políticas de democratização do acesso à educação superior no Brasil e de diversificação do corpo discente, tecemos algumas reflexões sobre o desenho institucional do PAD, os desafios que identificamos ao longo da construção do curso, e a nossa própria prática docente. Concluímos apontando a necessidade da institucionalização de ações afirmativas para um impacto mais significativo na promoção de um Programa de Pós-Graduação mais diverso e inclusivo.</p> <p>The aim of the article is to analyze and discuss our experience as monitors of the Introduction to Research in Law course belonging to the Support and Diversity Program (PAD) linked to the Academic Graduate Program at FGV São Paulo Law School. In 2021, its first year of operation, the PAD sought to offer pedagogical support to Black, indigenous, low-income students and/or graduates from public schools who wished to prepare for the selection process for admission to the institution’s academic master’s program. Using the systematization of experiences technique and in the light of contributions from the sociology of legal elites and recent debates on policies to democratize access to higher education in Brazil, we wove some reflections on the institutional design of the PAD, developed remotely during the COVID-19 pandemic, the challenges we identified throughout the construction of the course, and our own teaching practice. In this article, I answer these questions from the point of view of two visions: the era of legislators and the era of interpreters, presented by Zygmunt Bauman. Recommending a vision of judges as interpreters of the law, emphasising the importance of civic education, is the aim of the article. This task is accomplished on the basis of the two lines of argumentation. First, I show the dangers of the political entanglement of judges. Some of the forms of this entanglement can be linked to a legislative attitude that is rationalised by a culture of silence in public life. I then show that the era of interpreters makes it possible to present judicial freedom of expression as an act of communication between the sender of expression and its audience. Appreciating the position of the audience is linked to civic education.</p> <p class="PrrafoSortuz">¿Quiénes deben ser los jueces y cuál es su papel en la sociedad, especialmente en tiempos de inestabilidad política? En este artículo, respondo a estas preguntas desde el punto de vista de dos visiones: la era de los legisladores y la era de los intérpretes, presentada por Zygmunt Bauman. Recomendar una visión de los jueces como intérpretes de la ley, haciendo hincapié en la importancia de la educación cívica, es el objetivo del artículo. Esta tarea se lleva a cabo sobre la base de dos líneas de argumentación. En primer lugar, muestro los peligros del enredo político de los jueces. Algunas de las formas de este enredo pueden vincularse a una actitud legislativa racionalizada por una cultura del silencio en la vida pública. A continuación, muestro que la era de los intérpretes permite presentar la libertad de expresión judicial como un acto de comunicación entre el autor y su público. Tras revisar el disperso cuerpo de literatura sobre los efectos de la juridificación de la política indígena (Sieder), en este artículo se propone adoptar el modelo de estudio propuesto por Gloppen y Wilson (2017) que compagina este doble análisis desde una dimensión estrecha y amplia, y para la dimensión amplia se sugiere seguir las categorías planteadas por Dugard en 2022 (power-with, power-to, power-within y power-from dimensions). De esta manera, se logra abordar integralmente los efectos de la movilización legal indígena y obtener conclusiones más consistentes al realizar los estudios de casos.</p> <p>To assess the effects of juridifcation of indigenous politics and conclude whether it has led to the empowerment or domination of indigenous movements, it shall be considered not only trial outcomes from a narrow dimension (direct, material effects), but also indirect and symbolic effects of indigenous legal mobilizations; that is, assess the effects of legal mobilizations from a broader dimension. After reviewing the limited body of literature on the effects of juridification of indigenous politics (Sieder), it is recommended in this paper to follow the study model proposed by Gloppen and Wilson (2017). This model combines this double analysis from a narrow and broad dimension. Besides, for the broad dimension, it is suggested to follow the categories set out by Dugard in 2022 (power-with, power-to, power-within and power-from dimensions). Con ello ha aumentado la crítica y opinión acerca de los hechos sucedidos a partir de la continuación de su pena domiciliaria. Fueron cuatro las ocasiones en las que se plantearon medidas de seguridad entre las que suscitaron destitución y revocación hasta que finalmente el 28 de noviembre del 2022 obtuvo la boleta para su liberación de la cárcel nº4. A partir de ahí se realiza un análisis jurídico y cronológico desde la primera circunstancia en que fue concedida la garantía hasta su salida del centro penitenciario tomando como referencia el estudio del hábeas corpus desde su concepción. Para ello se analiza esta garantía jurisdiccional y su manejo mediante entrevistas en profundidad con expertos del área con la finalidad de evidenciar el papel que ha jugado esta herramienta de protección establecida en la Constitución la cual puede conformar la contrafigura de lo que promulga.</p> <p>The pre-release granted to the former Vice President of the Republic of Ecuador Jorge David Glas Espinel through the action of <em>habeas corpus</em> and calculation of the sentence has been controversial both for the general public as well as for the world of law. With this, criticism and opinion have arisen about the events that occurred after the following of his house sentence. There were four occasions on which security measures were raised, including those that led to dismissal and revocation until finally on November 28, 2022, he obtained the ticket for his release from jail no. 4. From there, a legal and chronological analysis is carried out from the first circumstance in which the guarantee was granted until his departure from the penitentiary center, taking as a reference the study of <em>habeas corpus</em> since his conception.
